Estate Planning & Probate
What is the process for estate planning?
Book a meeting. A free consultation can be booked any time online. If you do not see any convenient time slots available please call or email us and we will gladly coordinate calendars with you. When you book your initial meeting we will email you a brief questionnaire to get a general understanding of your circumstances. If you have existing estate planning documents in electronic form please email us a copy prior to our initial meeting.
Let’s talk. During our initial meeting we will go over your circumstances in detail, explore and advise you on your available options, address any questions you have, and provide you a detailed quote. Our initial meeting usually lasts 50 to 80 minutes.
Put us to work. If you desire to work with us we will send you an engagement letter to review and sign. We will prepare and provide you customized estate planning documents crafted to best achieve your goals and desires. It usually takes us 2-3 weeks to prepare your customized documents. We will correspond with you and meet with you as necessary to address any questions or revisions that you have. Once your documents meet with your approval we will assist you in finalizing them.
Wrap up. After your documents are finalized, we will provide you the originals for your safekeeping. We will also provide you electronic copies for easy reference. Finally, we will instruct you and your financial advisors on how to retitle certain of your assets and/or change beneficiary designations, if doing so is necessary or advisable to complement your new estate plan.
How much does an estate planning package cost?
Fixed-Pricing Arrangements. We provide an initial estate planning consultation at no charge. At the conclusion of the initial consultation, we recommend specific estate planning services that best fit your particular circumstances and goals. Whenever it is practical to do so, we assist clients with their estate planning needs for a fixed price as opposed to hourly rate billing. Fixed-pricing arrangements give our clients a clear understanding of the costs involved at the outset of the legal representation. Furthermore, fixed-pricing arrangements enhance our clients’ estate planning experience by encouraging our clientele to seek timely legal advice by communicating with us openly and often, without fear that they are “on the clock” and will incur additional charges. This allows us to form relationships with our clients built on trust and communication – two keys essential to effective estate planning.
Our current base rates for estate planning start at $1,500 and our advanced planning packages that include marital/asset protection trusts, tax-planning trusts, et cetera start at $2,500.
Standard Billing Policy. Upon your receipt of the estate planning documents we have prepared for you in draft form, you are responsible for full payment for our services. Payment shall be due upon your receipt of our billing statement unless other written arrangements have been made in advance.
Unanticipated Services. While a fixed-price arrangement allows unlimited consultation with us, in some situations, questions, new issues or other unanticipated needs beyond our control may arise that require additional research, analysis and/or expertise beyond the scope of services previously agreed upon at a fixed price. Hazard Law, PLLC reserves the right to price any such additional services separately — at either our standard hourly billing policy or at a new agreed upon fixed price.
I recently lost a loved one. Will I have to go through probate?
When a loved one dies not all assets “go through probate.” Only assets that do not pass by rights of survivorship or beneficiary designation go through probate.
